Welcome to FoodBUY.ng (“FoodBUY,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of the FoodBUY.ng website, mobile applications, and services (collectively, the “Platform”). By accessing or using FoodBUY, you agree to these Terms. If you do not agree, you must not use our services.
1. About FoodBUY
FoodBUY is an online marketplace and group-buying platform that enables users (“Members”) to join group purchases of food items, groceries, and related products in order to access discounted prices. FoodBUY itself does not manufacture or own the products listed by vendors. We act as a facilitator between vendors, buyers, and delivery partners.
2. Eligibility
- You must be at least 18 years old to use the Platform.
- By registering, you represent that all information provided is accurate, complete, and kept up-to-date.
- FoodBUY reserves the right to suspend or terminate accounts for violations of these Terms.
3. Group Buying Process
- Members may join group purchases within the time limits displayed on the Platform.
- If the required number of buyers is not met before the cut-off time, the group purchase may be canceled or rescheduled.
- Once you checkout and make payment, your participation in the group is confirmed.
4. Orders, Pricing & Payments
- Prices displayed on the Platform are subject to change until checkout is completed.
- Payments must be made through the approved payment methods integrated on FoodBUY.
- FoodBUY reserves the right to cancel fraudulent or suspicious orders.
5. Delivery & Logistics
- Delivery timelines depend on vendor availability, group buy completion, and logistics partners.
- While FoodBUY coordinates delivery, we are not liable for delays caused by vendors, transport issues, or unforeseen events.
- Risk of loss or damage passes to the buyer once the order is delivered to the designated address.
6. Refunds & Returns
- Refunds are available only in cases of:
- Out-of-stock items after payment.
- Canceled group purchases.
- Products received that are defective or unfit for consumption (subject to inspection).
- Refunds will be processed to your original payment method within [5–10 business days].
7. Vendor Responsibility
- Vendors are solely responsible for product quality, safety, and compliance with Nigerian food and consumer protection laws.
- FoodBUY does not guarantee vendor performance but may suspend vendors who repeatedly violate standards.
8. User Conduct
You agree not to:
- Use the Platform for fraudulent or illegal purposes.
- Misuse group-buy features to block genuine buyers.
- Post offensive, misleading, or harmful content.
9. Intellectual Property
- All logos, designs, and content on FoodBUY belong to FoodBUY or its licensors.
- You may not reproduce, distribute, or exploit any part of the Platform without written permission.
10. Privacy
We collect and process personal data in accordance with our Privacy Policy. By using FoodBUY, you consent to such processing.
11. Limitation of Liability
- FoodBUY acts as a facilitator and is not responsible for product defects, damages, or losses caused by vendors or logistics partners.
- To the maximum extent permitted by law, FoodBUY shall not be liable for indirect, incidental, or consequential damages.
12. Indemnity
You agree to indemnify and hold harmless FoodBUY, its affiliates, employees, and partners from any claims, losses, or damages arising out of your misuse of the Platform.
13. Termination
We may suspend or terminate your account if you breach these Terms or engage in harmful activity.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
